Sex Offender Attendance Policy

Sex offenders present a challenge for any organization — corporate, government, NGO, or faith-based — that may house, support, or otherwise have a nexus to vulnerable persons, children, or adults. How your organization handles the tension between a sex offender’s presence and the safety of others is complicated. Whether you operate a daycare at the office, host school tours, serve memory care residents, hold a company picnic, or run a community outreach event, this policy issue can arise in many contexts. Seek legal and insurance counsel before finalizing your approach.

Key Definitions (seek legal and insurance advice — definitions vary significantly by jurisdiction):

Sex Offender — Using Texas law as a reference point only: a person convicted of, or placed on deferred adjudication for, an offense related to sexual assault, aggravated sexual assault, indecency with a child, continuous sexual abuse of a young child, online solicitation of a minor, compelling prostitution, possession or promotion of child pornography, invasive visual recording (voyeurism), or certain kidnapping or unlawful restraint offenses depending on circumstances. Your jurisdiction’s definition will differ — confirm with legal counsel.

Attendance — For purposes of this policy, attendance includes any of the following:

  • Attending an event or service
  • Visiting the premises for any purpose — short-term or long-term
  • Being present on organization property or at an offsite organization event
  • Working or volunteering in any capacity

Scope: These rules apply to all personnel, buildings, suppliers, and events — onsite or offsite — where a person associated with the organization is a registered sex offender, or where there is a reasonable possibility that a sex offender may be present alongside vulnerable individuals.

Requirements — All Personnel:

  • I will report any verifiable sex offender observed in the presence of vulnerable persons to the organization’s security team, or directly to law enforcement if security is not available.
  • I will not confront a sex offender who is not observed doing anything wrong and where no vulnerable persons appear to be in distress or danger.
  • I will not announce the status or presence of a sex offender unless that status is verified and an immediate danger exists.

Requirements — Leadership:

  • I will establish organization-wide procedures for authorizing and managing a sex offender’s attendance, including enforcement of any related rules.
  • I will establish a defined geographic zone within organization events or facilities where a sex offender may safely participate when vulnerable persons are present. This zone designation will not be communicated through signage or any public expression.

Requirements — If I Am a Registered Sex Offender:

  • I will inform the HR team of my employment status and registration status upon hiring, and whenever that status changes.
  • I will respect and follow all organizational rules as they relate to my attendance and participation.
  • I will not knowingly violate the terms of my registration or any organizational restrictions while in attendance.
